Which companies are affected by the CPRA, the Californian Privacy Rights Act?
The California Privacy Rights Act (CPRA) affects any for-profit company worldwide that does at least one of the following:
Operates in California;
Has an annual revenue in excess of USD 25 million (before taxes);
Obtains, buys, sells or shares data from more than 100,000 California residents or households;
Generates more than 50 percent of its annual revenue from the sale or shares of personal data belonging to California residents.
Is the CPRA also relevant for German companies?
California is the fifth-largest economy in the world and is home to some of the largest and most influential technology companies. The CCPA has been in full effect since July 2020 and the CPRA since 2023. It affects all companies worldwide that meet the previously stipulated criteria. This means that German organisations are also affected. Failure to comply with the CPRA may result in severe penalties. It is therefore essential that your employees receive effective training on the California Privacy Rights Act.
Is CPRA training required by law?
No, there is no legal requirement for your employees to receive CPRA training. However, we strongly recommend that they do if your organisation is affected by the California Privacy Rights Act. Most data protection violations happen because of employee ignorance. With foreign statutes, such as the CPRA, this is even more frequently the case. Effective awareness will prevent violations and protect your company from severe penalties.
Which of my employees should I provide with CPRA training?
If your company is affected by the CPRA, all employees who have access to personal data should receive California Privacy Rights Act training. In particular, this includes data protection officers and associated executives as well as sales and marketing staff. This is the only way to prevent Data Protection violations.
