Which companies are affected by the Swiss Data Protection Act?
The scope of the Swiss Data Protection Act extends to data processing “which has an impact in Switzerland although it was initiated abroad”. Thus, it is not the location of the data processing that is relevant, but the alignment of the data processing towards Switzerland. The statute thus affects all companies worldwide that process the data of Swiss residents, e.g. by selling products and services in Switzerland.
